Purpose and scope
This policy applies to the Independent Medical Examiner Directory, private referral tools, organizational accounts, listing owners, reviewers, advertisers, staff, and administrators. It is a draft requiring review by qualified counsel.
Independent platform; no endorsement
The platform is an independent directory and technology service, not a medical practice. Listings, ratings, verification badges, featured profiles, sponsored placements, matching results, and comparisons do not constitute endorsement, guarantee, or a determination that an examiner is competent or suitable for a particular matter. Users must independently evaluate each professional.
IME limitations
An independent medical examination generally does not create a treating physician-patient relationship. IME services are not a substitute for medical treatment or emergency care. The directory does not control medical opinions and promises no particular result, favorable conclusion, report timing, testimony availability, impartiality, or case outcome. Information is not legal or medical advice. Examinees should direct case questions to their attorney, insurer, employer, or requesting organization. Emergency needs should be directed to appropriate emergency services—not an examiner or the directory.
Private referrals and conflict information
Private referral details and conflict-check information are restricted to authorized organization members, assigned examiner-office personnel, and authorized administrators according to role. Firm administrators, attorneys, paralegals, claims managers, physicians, office employees, billing personnel, and viewers may receive different permissions. Access and material status activity may be audited.
No medical-record storage at launch
Do not upload or paste medical records, patient information, ePHI, passwords, or public document links. Case-document storage is disabled until HIPAA-qualified hosting and vendors, applicable business associate agreements, encryption, multifactor authentication, access controls, retention and deletion rules, breach procedures, backup and recovery controls, and legal/security review are complete. Approved external secure-transfer systems must be used for records.
Professional feedback
Feedback is limited to verified retaining organizations and professional service factors such as communication, scheduling reliability, report timeliness, report clarity, responsiveness, administrative efficiency, and deposition preparedness. Feedback may not evaluate whether a medical opinion favored a party. Narrative feedback may remain private, and public aggregates require a minimum number of verified assignments. Payment cannot purchase better feedback or suppress legitimate feedback.
Verification and paid placement
Identity, license, board-certification, professional-liability, and documented-IME-experience checks are separate badges with review or expiration dates. Verification does not guarantee competence or suitability. Paid placement is labeled and separated from organic relevance; it does not affect verification status, comparisons, feedback, or medical opinions.
Account, privacy, and records
Users may request access, correction, export, or deletion of eligible personal data. The platform may preserve records required for security, fraud prevention, transactions, disputes, legal compliance, and auditability. Final retention schedules, state-specific privacy rights, breach notices, and data-processing terms require attorney and security review.
Contact and review
Questions, disputes, accessibility requests, privacy requests, and security reports may be submitted through the Contact and Help Center pages. Governing law, response deadlines, jurisdiction-specific notices, and final legal language must be completed by qualified counsel before launch.
